  3. The product, Focus v. 3.0 (in whole or in part, including all files, data, and documentation, 
  4. from here on referred to as "Software") is ⌐ Copyright 1998-2001 Francesco Savastano, all rights 
  5. reserved, and is protected by copyright laws, international treaties and all other applicable 
  6. national or international laws.  The sole owner of this product is Francesco Savastano .

  8. License Agreement
  9.  
  10. TITLE.  Title, ownership rights, and intellectual property rights in and to the Software and 
  11. Documentation shall remain in Francesco Savastano and/or its suppliers. 
  12. This Agreement does not include the right to copy or sublicense the Software and is personal 
  13. to you and therefore may not be assigned (by operation of law or otherwise) or transferred
  14.  without the prior written consent of Francesco Savastano.  You acknowledge that the Software 
  15. in source code form remains a confidential trade secret of Francesco Savastano and therefore 
  16. you agree not to attempt to decipher, decompile, disassemble or reverse engineer the Software
  17.  or allow others to do so, except to the extent applicable laws specifically prohibit such 
  18. restriction.  You further agree not to modify or create derivative works of the Software.
  19.  
  20. CONTENT.  Title, ownership rights, and intellectual property rights in and to the content 
  21. accessed through the Software is the property of the applicable content owner and may be 
  22. protected by applicable copyright or other law.  This License gives you no rights to such content.

  24. DISCLAIMER OF WARRANTY.  The Software is provided on an "AS IS" basis, without warranty of any 
  25. kind, including without limitation the warranties of merchantability, fitness for a particular 
  26. purpose and non-infringement.  The entire risk as to the quality and performance of the Software
  27.  is borne by you.

  29. Should the Software prove defective, you and not Francesco Savastano assume the entire cost of 
  30. any service and repair.

  32. This disclaimer of warranty constitutes an essential part of the agreement.  
  33. SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO 
  34. YOU AND YOU MAY HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.

  36. LIMITATION OF LIABILITY.  UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR 
  37. OTHERWISE, SHALL Francesco Savastano OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER
  38.  PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER 
  39. INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR 
  40. MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.  
  41. TERMINATION.  Either party may terminate this Agreement immediately in the event of default by 
  42. the other party. Upon any termination of this Agreement, you shall immediately discontinue the 
  43. use of the Software and shall within ten (10) days return to Francesco Savastano all copies of 
  44. the Software and Documentation. You may also terminate this Agreement at any time by destroying 
  45. the Software and Documentation and all copies thereof. Your obligations to pay accrued charges 
  46. and fees shall survive any termination of this Agreement.

  49. Restrictions

  51. You may not use, copy, modify, translate, or transfer the product or any copy except as expressly
  52.  defined in this agreement. You may not attempt to unlock or bypass any copy-protection or 
  53. authentication algorithm utilized by this product. You may not remove or modify any copyright 
  54. notice, nor any "about" dialog or the method by which it may be invoked.
